Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Waifu.Zone ("Company," "we," "us," or "our") governing your access to and use of the Waifu.Zone platform, including all associated websites, applications, APIs, tools, models, generated content, and services (collectively, the "Service"). By accessing or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Eligibility & Age Verification

1.1. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction (whichever is greater), to access or use the Service. By using the Service, you represent and warrant that you meet this age requirement.

1.2. We reserve the right to request proof of age at any time. Failure to provide satisfactory proof of age upon request will result in immediate suspension of your account.

1.3. The Service is not available in jurisdictions where the generation or distribution of adult content is prohibited by law. You are solely responsible for ensuring compliance with your local laws.

1.4. We may employ age verification technologies, including but not limited to third-party identity verification services. By using the Service, you consent to such verification processes.

2. Description of Service

2.1. Waifu.Zone is an AI-powered content generation platform specializing in NSFW (Not Safe For Work) image and media creation. The Service uses proprietary and third-party machine learning models to generate visual content based on user-provided text prompts and parameters.

2.2. The Service includes, but is not limited to: text-to-image generation, image-to-image transformation, inpainting, face swapping, style transfer, body editing, NSFW video generation, and related AI tools.

2.3. The Service is currently operating under a Pilot Program. During the Pilot phase, features, models, generation limits, pricing, and availability are subject to change without prior notice. We make no guarantees regarding the continuous availability of any specific feature during the Pilot phase.

2.4. All AI-generated content is produced algorithmically and does not depict real persons unless a user explicitly provides reference images. We do not manually create, curate, or endorse any specific generated output.

3. Account Registration & Security

3.1. To access certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy.

3.2. You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any API keys. You agree to immediately notify us of any unauthorized use of your account.

3.3. You may not share, sell, transfer, or license your account to any third party. Each account is for a single individual user only.

3.4. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared or operated by multiple individuals, used for automated bulk generation beyond reasonable personal or commercial use, or are otherwise in violation of these Terms.

3.5. You are responsible for all activity that occurs under your account, whether or not you authorized such activity.

4. Credits, Payments & $WAIFU Token

4.1. The Service operates on a credit-based system. Credits are the in-app currency consumed when you use generation features. Credits can be purchased directly or earned by staking $WAIFU tokens. The credit cost per generation varies based on the type of generation, quality settings, and model selected.

4.2. Current credit costs are as follows (subject to change):

4.3. Credits are purchased through the Service using supported payment methods. All purchases are final. Credits are non-refundable except as required by applicable law or at our sole discretion.

4.4. Credits do not expire. Unused credits remain in your account indefinitely for as long as your account is in good standing.

4.5. Credits are non-transferable between accounts unless explicitly facilitated through an authorized feature of the Service.

4.6. We reserve the right to modify credit pricing, adjust credit costs for specific features, or introduce new pricing tiers with reasonable notice. Changes to pricing will not retroactively affect credits already purchased.

4.7. Subscription plans (Tease, Foreplay, Climax, Hentai God) are billed on a recurring monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing cycle. No partial refunds are provided for unused portions of a billing cycle.

4.8. Free tier ("Tease") users receive a daily allocation of credits that reset every 24 hours. Unused daily free credits do not roll over.

5. Pilot Pass NFT

5.1. The Pilot Pass is a blockchain-based digital asset (NFT) that grants the holder specific benefits on the Waifu.Zone platform, including but not limited to: lifetime platform access, monthly credit allocations, priority generation queue, and access to exclusive models.

5.2. The total supply of Pilot Passes is capped at 1,000. 690 passes were sold during the private presale phase and are currently awaiting distribution. The remaining 310 passes will be offered in a public sale at a date to be announced.

5.3. Pilot Pass benefits are tied to the NFT itself, not to the original purchaser. If you sell or transfer your Pilot Pass, the benefits transfer to the new holder.

5.4. We reserve the right to modify the specific benefits associated with the Pilot Pass, provided that any modifications do not materially diminish the core value proposition offered at the time of original sale.

5.5. Pilot Pass purchases are conducted on the Ethereum blockchain. We are not responsible for transaction failures, gas fees, wallet security, or any losses resulting from blockchain-related issues.

6. Acceptable Use Policy

6.1. You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

  1. Generate, distribute, or store content depicting minors (persons under 18) in any sexual, suggestive, or exploitative context. This is an absolute prohibition with zero tolerance.
  2. Generate content using the likeness of real, identifiable persons without their explicit, documented consent.
  3. Generate content intended to harass, threaten, intimidate, stalk, or defame any individual.
  4. Generate content that promotes or incites violence, terrorism, self-harm, or hatred against any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics.
  5. Generate content that violates any applicable local, state, national, or international law or regulation.
  6. Attempt to reverse-engineer, decompile, disassemble, or extract the weights, architecture, or training data of any AI model used by the Service.
  7. Use automated tools (bots, scrapers, scripts) to access the Service in a manner that exceeds reasonable use or circumvents rate limits without written authorization.
  8. Resell, sublicense, or redistribute access to the Service or its outputs in a manner that competes with the Service itself.
  9. Circumvent, disable, or interfere with any security, access control, or digital rights management features of the Service.
  10. Upload malicious code, viruses, or any material designed to disrupt or damage the Service or its infrastructure.
  11. Impersonate any person or entity, or falsely claim affiliation with any person or entity.
  12. Use the Service to generate content for the purpose of fraud, deception, or misinformation campaigns.
Zero-tolerance policy: Any content involving the depiction of minors in sexual contexts will result in immediate, permanent account termination, forfeiture of all credits and passes, and reporting to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.

7. Intellectual Property & Content Ownership

7.1. Your Content. Subject to the license granted below, you retain ownership of the text prompts you provide and the images generated through your use of the Service. The extent of your usage rights depends on your subscription tier:

7.2. License to Us. By using the Service, you grant Waifu.Zone a non-exclusive, worldwide, royalty-free license to process, transmit, and temporarily cache your prompts and generated content solely for the purpose of providing the Service. We do not use your prompts or generated content to train our AI models unless you explicitly opt in to a data contribution program.

7.3. Our Content. The Service, including its design, code, models, branding, documentation, and all non-user-generated content, is owned by Waifu.Zone and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content.

7.4. AI Model Outputs. AI-generated images are created through algorithmic processes. While we grant you usage rights as described above, the legal status of AI-generated content under copyright law varies by jurisdiction. We make no representation regarding the copyrightability of AI-generated content in your jurisdiction.

7.5. Watermarks. Free tier outputs include a visible Waifu.Zone watermark. Removal or alteration of watermarks on free tier content is prohibited.

8. Privacy & Data Handling

8.1. Your use of the Service is also governed by our Privacy Policy (see below), which is incorporated into these Terms by reference.

8.2. By using the Service, you consent to the collection, use, and processing of your information as described in the Privacy Policy.

9. Disclaimers & Limitation of Liability

9.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9.2. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. During the Pilot phase, service interruptions, bugs, and feature changes should be expected.

9.3. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAIFU.ZONE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  1. Your access to, use of, or inability to access or use the Service;
  2. Any conduct or content of any third party on the Service;
  3. Any content obtained from the Service;
  4. Unauthorized access, use, or alteration of your transmissions or content;
  5. Any bugs, viruses, or similar harmful code transmitted through the Service;
  6. Service interruptions, downtime, or data loss during the Pilot phase.

9.4. Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the total amount you have paid to us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

10. Indemnification

10.1. You agree to indemnify, defend, and hold harmless Waifu.Zone and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you generate, upload, or distribute through the Service.

11. Dispute Resolution & Governing Law

11.1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2. Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If informal resolution is unsuccessful within thirty (30) days, the dispute shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

11.3. Class Action Waiver. You agree that any arbitration or proceeding shall be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.

11.4. Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Modifications to Terms

12.1. We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service, via email, or by posting a prominent notice on our website at least fourteen (14) days before the changes take effect.

12.2. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.

13. Termination

13.1. You may terminate your account at any time by contacting us or using the account deletion feature (when available). Upon voluntary termination, unused purchased credits remain available for 90 days.

13.2. We may suspend or terminate your account immediately, without prior notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Service or other users.

13.3. Upon termination for cause (violation of Terms), all credits, passes, and associated benefits are immediately forfeited without refund.

13.4. Sections 7 (IP), 9 (Liability), 10 (Indemnification), and 11 (Disputes) survive termination of these Terms.

14. Miscellaneous

14.1. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.2. Entire Agreement. These Terms, together with the Privacy Policy, Content Policy, and DMCA Policy, constitute the entire agreement between you and Waifu.Zone regarding the Service.

14.3. Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.4. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

14.5. Force Majeure. We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, internet outages, or third-party service failures.

Privacy Policy

This Privacy Policy describes how Waifu.Zone ("Company," "we," "us," or "our") collects, uses, discloses, and protects your personal information when you use our platform and services. We are committed to protecting your privacy, particularly given the sensitive nature of our Service.

1. Information We Collect

1.1. Information You Provide Directly

  • Account Information: Email address, username, password (hashed), display name, profile settings.
  • Payment Information: Billing address, payment method details. Note: Full payment card details are processed and stored exclusively by our PCI-DSS compliant payment processor (Stripe). We do not store your full card number.
  • Wallet Information: Ethereum wallet address (for Pilot Pass NFT transactions only). We do not have access to your wallet's private keys.
  • Communication Data: Any information you provide when contacting support, submitting feedback, or reporting content.
  • Prompts & Inputs: Text prompts, parameter settings, and reference images you provide when using generation features.

1.2. Information Collected Automatically

  • Device & Browser Information: Device type, operating system, browser type and version, screen resolution, language preferences.
  • Usage Data: Features used, generation counts, credit consumption, session duration, pages visited, buttons clicked, feature preferences.
  • Network Information: IP address, approximate geolocation (country/region level only), internet service provider.
  • Log Data: Server logs including timestamps, request URLs, HTTP status codes, referrer URLs, and user agent strings.
  • Cookies & Local Storage: Session identifiers, authentication tokens, user preference settings (see Section 5).

1.3. Information We Do NOT Collect

  • We do not collect your real name unless you voluntarily provide it.
  • We do not collect biometric data.
  • We do not collect precise GPS location data.
  • We do not collect data from your device's camera, microphone, or contacts.

3. Generated Content & Prompts

3.1. Image Storage. Generated images are temporarily cached on our servers for delivery (typically less than 24 hours) and then permanently deleted from our systems. We do not maintain a permanent archive of generated content.

3.2. Prompt Logging. Text prompts are logged for a rolling 30-day period for abuse detection and prevention purposes. Prompts older than 30 days are permanently deleted or irreversibly anonymized.

3.3. Model Training. We do NOT use your prompts, generated images, or reference images to train our AI models unless you explicitly opt in to our voluntary Data Contribution Program. Participation in this program is entirely optional and can be revoked at any time.

3.4. Content Scanning. Generated images may be automatically scanned using hash-matching technology (e.g., PhotoDNA) to detect and prevent the generation of child sexual abuse material (CSAM). This scanning occurs in an automated fashion and does not involve human review of non-flagged content.

4. Data Sharing & Third Parties

4.1. We do NOT sell your personal information. We have never sold user data and have no plans to do so.

8.1. Our servers are located in the United States. If you are accessing the Service from outside the United States, your data will be transferred to and processed in the United States.

8.2. For users in the European Economic Area (EEA), United Kingdom, or Switzerland, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission as the legal mechanism for data transfers.

9. Children's Privacy

9.1. The Service is strictly for users aged 18 and over. We do not knowingly collect personal information from anyone under 18 years of age. If we discover that we have collected information from a minor, we will delete it immediately and terminate the associated account.

10. Changes to This Policy

10.1. We may update this Privacy Policy from time to time. We will notify you of material changes by posting a notice on the Service and, where possible, by email, at least 14 days before changes take effect.

Content Policy

Waifu.Zone is an adult content generation platform. We believe in creative freedom for adults while maintaining clear boundaries to prevent harm. This Content Policy defines what is and is not permitted on our platform.

1. Platform Classification

1.1. Waifu.Zone is classified as an adult content platform. All content generated on the platform should be considered NSFW (Not Safe For Work) by default.

1.2. The platform is designed for the generation of fictional content. All generated characters are AI-created and do not represent real individuals unless explicitly intended by the user using authorized reference images.

2. Permitted Content

The following types of content are permitted on Waifu.Zone:

  • NSFW images of fictional adult characters (anime, realistic, fantasy, sci-fi, etc.)
  • Artistic nudity and erotic art featuring fictional adult characters
  • Explicit sexual content between consenting fictional adult characters
  • Fantasy scenarios involving fictional characters (e.g., monster girls, elves, demons, etc.)
  • Fan art of fictional characters from anime, manga, games, and other media (characters must be depicted as adults 18+)
  • BDSM and kink content between consenting fictional adult characters
  • Fetish content that does not violate the prohibited categories below

3. Strictly Prohibited Content

The following categories are absolutely prohibited. Violations will result in immediate, permanent account termination, forfeiture of all credits and passes, and may be reported to law enforcement.

3.1. Child Sexual Abuse Material (CSAM) — Zero Tolerance

  • Any sexual or suggestive depiction of minors (persons under 18), whether realistic, anime-styled, or otherwise.
  • Characters that appear to be minors, regardless of any stated "fictional age."
  • "Loli" or "shota" content depicting characters with childlike physical characteristics in sexual contexts.
  • Age regression or de-aging of characters into child-like forms for sexual purposes.

We employ automated CSAM detection (hash-matching, classifier models) and report all confirmed cases to NCMEC and law enforcement.

3.2. Non-Consensual Real Person Content

  • Sexual deepfakes or face-swapped content using the likeness of real people without their verified, documented consent.
  • Revenge porn or non-consensual intimate imagery of real individuals.
  • Content intended to harass, intimidate, or blackmail real individuals.

3.3. Violence & Harm

  • Sexual content involving graphic, realistic violence, torture, or mutilation.
  • Content glorifying or promoting sexual violence or rape as entertainment.
  • Content promoting self-harm, suicide, or eating disorders.
  • Content depicting necrophilia or sexual acts involving death.

3.4. Illegal Content

  • Bestiality or zoophilia (sexual acts involving real animals).
  • Content that promotes or facilitates human trafficking or sexual exploitation.
  • Content that violates international humanitarian law.

3.5. Hate & Discrimination

  • Content that promotes hatred, violence, or discrimination against individuals or groups based on protected characteristics (race, ethnicity, religion, gender, sexual orientation, disability, national origin).
  • Content depicting racial or ethnic stereotypes in a sexual or degrading context with the intent to dehumanize.

4. Gray Areas & Moderation Approach

4.1. We recognize that the boundary between permitted and prohibited content is not always clear-cut. In ambiguous cases, we apply the following principles:

  • Character Appearance Test: Characters must reasonably appear to be adults (18+) based on physical characteristics, regardless of any stated fictional age.
  • Intent Assessment: We consider the apparent intent behind the content, not just its surface appearance.
  • Context Evaluation: The same image may be acceptable in one context and prohibited in another.
  • Err on the Side of Caution: When genuinely uncertain, we err toward restriction rather than permission.

4.2. Users may appeal moderation decisions by contacting appeals@waifu.zone. Appeals are reviewed by a senior moderator within 5 business days.

5. Content Moderation Methods

5.1. We employ a multi-layered moderation approach:

  • Pre-generation Prompt Filtering: Automated systems scan prompts for keywords and patterns associated with prohibited content before generation begins.
  • Post-generation Image Classification: AI classifiers analyze generated images to detect prohibited content categories.
  • Hash Matching: Generated images are compared against known CSAM databases (e.g., NCMEC hash list) using perceptual hashing.
  • User Reporting: Users can report content they believe violates this policy.
  • Human Review: Flagged content is reviewed by trained human moderators. Human review is conducted only on flagged content, not on all generated content.

7. Reporting Violations

7.1. If you encounter content that you believe violates this policy, report it to abuse@waifu.zone with as much detail as possible.

7.2. We will acknowledge reports within 24 hours and take action within 48 hours for standard violations. Reports involving potential CSAM are escalated immediately.

7.3. Reports are treated confidentially. We do not reveal the identity of reporters to the reported user.

8. Changes to This Policy

We may update this Content Policy as community standards, legal requirements, and AI capabilities evolve. Material changes will be communicated at least 14 days in advance.

DMCA Policy

Waifu.Zone respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

2. Filing a DMCA Takedown Notice

2.1. If you are a copyright owner, or authorized to act on behalf of one, and believe that content on or generated through our Service infringes your copyright, you may submit a written DMCA takedown notice containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work(s) claimed to have been infringed. If multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., URL, username, generation ID, description with identifying details).
  4. Your contact information: full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
Knowingly submitting a false or fraudulent DMCA notice may result in liability for damages under 17 U.S.C. § 512(f), including costs and attorneys' fees incurred by the alleged infringer or by us.

3. Our Response to Valid Notices

3.1. Upon receipt of a valid DMCA takedown notice, we will:

  • Promptly remove or disable access to the allegedly infringing material.
  • Notify the user who generated or uploaded the material (the "alleged infringer") that the material has been removed or disabled.
  • Provide the alleged infringer with a copy of the takedown notice and information about filing a counter-notification.

3.2. We aim to process valid DMCA notices within 3 business days of receipt.

4. Counter-Notification

4.1. If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Waifu.Zone may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

5. Restoration of Content

5.1. Upon receipt of a valid counter-notification, we will:

  • Forward the counter-notification to the original complainant.
  • Inform the original complainant that the removed material will be restored in 10 business days unless we receive notice that the complainant has filed a court action seeking to restrain the alleged infringer from engaging in infringing activity.
  • Restore the removed material between 10 and 14 business days after receipt of the counter-notification, unless the original complainant provides evidence of a filed court action.

6. Repeat Infringer Policy

6.1. In accordance with the DMCA, we maintain a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

6.2. A "repeat infringer" is defined as a user against whom we have received three (3) or more valid DMCA takedown notices for separate instances of alleged infringement. Counter-notifications that are not challenged by the original complainant do not count toward repeat infringer status.

6.3. Upon determination of repeat infringer status, the user's account will be permanently terminated. All credits and passes associated with the account will be forfeited.

7. AI-Generated Content & Copyright

7.1. We acknowledge that the application of copyright law to AI-generated content is an evolving area of law. Our DMCA process applies to:

  • Generated content that incorporates copyrighted reference images provided by users.
  • Generated content that substantially reproduces recognizable copyrighted characters, scenes, or artistic works.
  • Any content uploaded to or distributed through the Service that infringes copyright.

7.2. We evaluate DMCA claims involving AI-generated content on a case-by-case basis, considering the degree of similarity, the nature of the copyrighted work, and applicable fair use principles.

8. Misuse of DMCA Process

8.1. We take the misuse of the DMCA process seriously. If we determine that a party has knowingly submitted false DMCA notices or counter-notifications, we may:

  • Terminate the offending party's account (if they are a user of the Service).
  • Pursue legal action for damages under 17 U.S.C. § 512(f).
  • Report the abuse to appropriate authorities.
